Liability Waiver

By participating in any yoga session, programme, course, workshop, or private session offered by Sushi Yogi (Sushmitha Shrikanth), you acknowledge and agree to the following:

1. Voluntary participation

I confirm that my participation in yoga classes, live sessions, recorded sessions, and any associated course materials is entirely voluntary. I understand that yoga involves physical movement and that, as with any physical activity, there is an inherent risk of injury.

2. Affirmative health declaration

I confirm that I am in suitable physical and mental health to participate in yoga practice. Where I have any pre-existing medical condition, injury, or physical or mental health limitation, I have consulted with a qualified medical professional prior to participation and have disclosed the relevant information to my teacher before commencing practice.

3. Yoga is not medical or psychological treatment

I understand that yoga practice with Sushi Yogi is not a substitute for medical treatment, physiotherapy, psychotherapy, or psychiatric care. If I have a diagnosed mental or physical health condition, I will not rely on this practice as a substitute for care from a qualified healthcare provider.

4. Assumption of risk

I understand and accept that yoga practice may involve physical exertion and that there is an inherent risk of injury. I voluntarily assume full responsibility for any and all risks associated with my participation, including but not limited to: muscle strain, joint injury, falls, or aggravation of pre-existing conditions.

5. Release of liability, including for negligence

To the fullest extent permitted by applicable law, I release and hold harmless Sushi Yogi, Sushmitha Shrikanth, and any associated instructors, assistants, or staff from any and all claims, damages, losses, or expenses (including legal fees) arising from my participation in any yoga session, programme, or activity, whether caused by negligence or otherwise. This release does not exclude or limit any liability that cannot be excluded or limited by South African law.

6. Modifications and personal responsibility

I understand that it is my responsibility to listen to my body and to modify or skip any posture that does not feel appropriate for my body on any given day. I will communicate any discomfort, pain, or injury to the teacher as soon as reasonably possible.

7. Online practice space safety

For online and live-streamed sessions, I acknowledge that I am practising in my own space and that it is my sole responsibility to ensure that space is safe, clear of hazards, level, and appropriate for yoga practice. Sushi Yogi has no visibility of my practice space and accepts no liability for any injury, loss, or damage occurring in my personal practice space.

8. Teacher’s inability to deliver sessions

Sushi Yogi sessions are delivered solely by Sushmitha Shrikanth. In the event that she is unable to deliver a scheduled session due to illness, personal circumstances, internet outage, travel, force majeure, or any other reason beyond reasonable control, the session will at her discretion be rescheduled, replaced with a recording, or credited. Sushi Yogi is not liable for the non-delivery of a session in such circumstances.

9. Governing law

This waiver is governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts, without prejudice to any mandatory statutory rights you may have in your country of residence. If any provision of this waiver is found to be unenforceable, the remaining provisions shall continue in full force and effect.
